EPR Textiles Decree

  • What is EPR?

    Extended Producer Responsibility (EPR) makes producers and importers responsible for the entire lifecycle of their products, from design through to the waste phase. The government aims to reduce the environmental impact of textiles and encourage companies to use waste for reuse and recycling, making it available as a new raw material.

  • Who does the EPR Textiles Decree apply to?

    The EPR Textiles Decree applies to producers and importers who professionally place consumer and workwear, table, bed, and household linen on the Dutch market for the first time. This also includes textiles containing recycled content. It does not matter to whom the product is offered — whether to a business or directly to a consumer.

  • What does this mean for producers or importers?

    Does your company place clothing or household textiles on the Dutch market for the first time? Then you must ensure a nationwide collection system where consumers can always and everywhere in the Netherlands deposit their discarded textiles free of charge. You must also provide transparency on what happens to these textiles and report annually on your performance in collection, recycling, and reuse.

  • Who oversees implementation and compliance?

    We ensure that our agreements with supply chain partners and service providers regarding collection and processing are upheld. Participants report their volumes annually and pay the fee. We monitor the results and report to the Ministry of Infrastructure and Water Management. 

    In addition, we act as the point of contact for the Human Environment and Transport Inspectorate (ILT) on behalf of our participants. This way, we maintain control over implementation and ensure that everyone meets their obligations.

  • Where can I find additional information from the national government?
  • Is the Foundation active internationally?

    We closely follow European legislation and bring together knowledge and insights. Based on this, we actively contribute in Brussels and on European platforms, advocating for clear, harmonised rules across borders. This gives producers a single clear framework and promotes a broad European textile approach, including trade agreements that encourage more circularity. By connecting stakeholders across the chain, we jointly accelerate the transition to a circular textile system.

  • What about other legislation regarding textiles?

    The Dutch EPR Textiles Decree focuses on the end-of-life phase of textile products: the waste phase. At the EU level, additional legislation is forthcoming that will impact the current Dutch regulations. Through our network in Brussels, we closely monitor EU developments to serve our producers and importers as effectively as possible.

  • Which companies are on the board of Stichting UPV Textiel?

    The board of Stichting UPV Textiel consists of executives from Angro, Beddinghouse, Company Fits, Tommy Hilfiger, Livera, WE Fashion, Wibra, Zeeman en INretail/Modint.

Collection and processing

  • How does the foundation organise the collection and processing in order to achieve its objectives?

    In 2025, the Foundation began implementing the collection and processing of textiles. To this end, we developed a Textile Management Structure. This involves establishing an effective and efficient collection and processing system to meet the EPR (Extended Producer Responsibility) objectives, a compensation scheme, a certification system, and monitoring to track what happens to discarded textiles. On behalf of the participating producers and importers, the Foundation has entered into agreements with the executing parties.

Producers & importers

  • How does the registration process work?

    Registering as a producer or importer? Follow the three steps below: 

    1. Sign up: submit your details via this form. 
    2. Sign the Textile Management Contribution Agreement (TMFA): after registration, you will receive an email with the TMFA, an explanation, and the general terms and conditions. We ask you to sign the agreement digitally and return it. 
    3. Submit your statement: provide a forecast of the amount of textiles your company expects to place on the Dutch market that year. After signing the TMFA, you will receive an email invitation to submit a preliminary declaration. 
  • Participation and the Textile Management Fee Agreement (TMFA)

    The Textile Management Fee Agreement (TMFA) sets out the obligations between the Participants and the Foundation regarding the implementation of the delegated statutory obligations. By signing the TMFA, you confirm your participation in Stichting UPV Textiel. You also agree that the foundation will fulfil the EPR obligations on your behalf and that you will comply with the associated agreements. 

    Upon receipt of the signed TMFA by Stichting UPV Textiel, you become an official and legally recognised participant, and the foundation assumes your individual responsibilities. The TMFA also forms the basis for submitting a request for the General Binding Declaration (AVV) of this TMFA. This ensures that all suppliers and importers placing products on the Dutch market contribute, maintaining a level playing field. The TMFA incorporates the legal provisions necessary to request an AVV.

  • Who is a producer and must comply with the obligations?

  • Which products fall under the EPR Textiles Decree?

    The EPR Textiles Decree applies to certain textile products. You can find out which ones on the Rijkswaterstaat website – Scope of EPR Textiles.

  • Which companies are participants?

    Many producers and importers have now joined Stichting UPV Textiel. The participant list provides an overview of our members. Participants on this list may also represent sub-participants.

  • Is there a distinction between large and small companies?

    We are here for all textile producers and importers based in the Netherlands. By uniting the interests of both large and small producers, we ensure a widely supported approach with real impact.

  • What should I record in my textile administration?

    We have researched best practices for textile administration. A complete textile administration should include the following: 

    • A process description explaining how you selected the market for which you submit a declaration. 
    • An Excel document listing these products along with their corresponding weights.

  • What should I include in my statement?

    By April 1st, you submit a statement of the number of kilograms of textiles you expect to place on the Dutch market that year. Based on this statement, you pay a provisional fee. The following year, by April 1st, you report the actual volumes placed on the market in the previous calendar year. Any difference in fees will then be reconciled.

    You submit your statement in kilograms.

Textile management fee

  • How is the fee determined?

    The board of Stichting UPV Textiel sets the annual budget and the provisional and final rates of the textile management fee. The board consists of executives from Angro, Beddinghouse, Company Fits, Fabienne Chapot, Livera, WE Fashion, Wibra, Zeeman, and INretail/Modint. The textile management fee is largely determined by the costs required to carry out collection and processing to achieve the objectives, as well as to cover the market scope of the producers’ organisation.

  • What is the fee used for?

    As a producer/importer, you pay the producers’ organisation a fee to support increased and better-sorted collection, achieve reuse and recycling targets, promote necessary innovation and the transition to circularity, and foster collaboration for sustainability across the supply and processing chain.

  • When do I have to pay the fee?

    You pay an annual provisional fee based on the weight of textiles you expect to place on the Dutch market for the first time. The following year, by April 1st, you report the actual volumes placed on the market in the previous calendar year. Any difference in fees will then be reconciled. You only pay for textiles actually placed on the market. 

    Large companies receive an invoice each quarter for one quarter of the provisional textile fee, while smaller companies are invoiced once a year, in September. The final invoice is issued after the submission of the definitive statement.

Service providers

  • Who can register as a service provider?

    You can register if you: 

    • Collect textiles, either directly or via collection services, and clean them in the Netherlands 
    • Sort textiles for product reuse or material recovery 
    • Sort textiles for fibre-to-fibre recycling 
    • Recycle textiles into yarns through fibre-to-fibre recycling 

     

  • How does the registration process work?
    1. Registration and intake
    • Shortly afterwards, your dedicated account manager from Stichting UPV Textiel will contact you. 
    • You will receive a checklist to clearly map out your situation. 
    • During the intake, we go through everything together, from your activities to the possibilities for contracting. 
    • After the session, you will receive a clear report with the next steps. 

    We make sure you have enough time and space to provide your information and keep you well informed throughout the process. 

    If the registration is not yet complete, we will let you know and advise you on what is required. 

    1. Contracting
    • Based on the intake discussion, we jointly draft an agreement tailored to your organisation and activities. 
    • You will receive the Service Agreement digitally, ready for signature. 
    • If it is not possible to finalise the contracting within the set timeframe, we will work with you to determine what is still needed. Ultimately, we will proceed to the next registration on the list, which we will communicate well in advance.

  • When does a guarantee fee apply?

    In 2025, you can receive a guarantee compensation* after each quarter if you: 

    • Have signed the 2025 Textile Management Service Agreement; 
    • Collect or sort discarded textiles in the Netherlands in accordance with the EPR Textiles Decree; 
    • Are connected to the Retex monitoring system; 
    • Submit the required monitoring data. 

    *Conditions apply to these compensations based on the 2025 Textile Management Service Agreement. 

     

  • When does a transition fee apply?

    Your pilot may be eligible for a transition fee* if: 

    • The textiles in the Netherlands are discarded and eligible for a guarantee fee for collection and sorting; 
    • The textiles have been weighed by a recognised service provider, consist of specifically sorted post-consumer textiles, and meet the quality requirements to retain fibres in the chain; 
    • The entire process, from sorting to production and sale of the intermediate product (at least yarn), is fully documented, preferably with a circular label; 
    • CSR conditions according to OECD guidelines have been checked and secured; 
    • The costs and impact of the pilot are clear, along with its contribution to the EPR objectives; 
    • There is a purchase guarantee from the producer of the product (domestic or international) in which the fibres are used. 

    *Conditions apply to these fees based on the 2025 Textile Management Service Agreement. 

  • When do I comply with the Recognition Scheme?

    To enter into a Service Agreement with us, you must meet the requirements of the Recognition Scheme. In 2024, this scheme was developed together with the umbrella organisations Vereniging Herwinning Textiel (VHT), Branchevereniging Kringloop Nederland (BKN), and Koninklijke Nederlandse Vereniging voor Afval- en Reinigingsdiensten (NVRD). 

    If you are a member of VHT, NVRD, or BKN and hold a VHT certificate, BKN quality mark, or an equivalent combination of certifications and registrations covering quality, health & safety, environment, and transport, we can provisionally recognise your company. We will then assess whether you are eligible for a compensation, either in advance of or during the recognition audit.

  • Why is a Recognition Scheme important?

    We only work with recognised service providers. This ensures proper attention to quality, health & safety, and the environment. The Recognition Scheme helps your organisation further improve processes and maintain a transparent and reliable textile administration

Municipalities

  • Why collaborate with a recognised service provider?

    Insight. Control. And a supply chain that works for you. This is what you gain by working with a service provider affiliated with Stichting UPV Textiel. Using the dashboard in our monitoring system, Retex, you can easily see how much textile has been collected in your municipality, what has been cleaned and sorted, and where the textiles then move to within the chain.

  • Can municipalities also claim fees?

    Do you provide containers as a municipality, or organise the collection yourself? 
    Then your efforts may fall under the guarantee fee that we provide to the service provider. If this is the case, you can make arrangements with the service provider regarding compensation for your costs.

  • How can I request an account for the Retex dashboard?
